Government Data Request Policy

This policy explains how we handle requests for personal data from law enforcement, prosecutors, courts and other public authorities. We take our responsibility to protect our clients' data — and the data of their followers — seriously, and we do not comply with any request automatically.

1. Review of legality

Every request is reviewed for its legal basis before we respond. We verify that it comes from a competent authority, that it is properly formed (in writing, signed, stating its legal basis), and that the data sought is relevant to the scope of the request. Where we deem it necessary, we consult our legal counsel before responding. Requests received verbally or through informal channels are not answered.

2. Challenging unlawful requests

If we consider a request unlawful, overly broad or without proper basis, we do not comply. In that case we refuse it in writing, state our reasons, and where necessary pursue the objection routes provided by law. Asking for the scope of a request to be narrowed is part of this step.

3. Data minimisation

Where we must comply with a request, we disclose only the minimum data expressly named in it and legally required. Records outside the scope of the request, data belonging to unrelated clients, and access tokens are never disclosed under any circumstances. Bulk data requests are not fulfilled.

4. Documentation

Every request we receive, the response we give, the legal reasoning behind the decision, the people involved and the relevant dates are recorded. These records are retained for the period required by law and can be produced in the event of an audit.

5. Notifying the user

Unless we are legally prevented from doing so, we inform the client whose data is being requested, so that they can exercise their own legal rights. Where a confidentiality order applies, this notice is deferred until the restriction is lifted.
